The Contest

• These terms and conditions (“Terms”) are with reference to your participation in the mid-innings quiz contest (“Contest”). The Contest is being organized by Irelia Sports India Private Limited (“ISIPL”), the owner and operator of the Gujarat Titans professional twenty20 cricket team (“Gujarat Titans”/“GT”) participating in the Indian Premier League 2024 (“League”). GT is offering the Contest on GT’s official TitansFAM App (collectively, the Platform).
• For the purpose of these Terms, “you” and “your” shall mean any individual who wishes to participate in the Contest. By submitting the answers on the quiz feature (as defined herein), you unconditionally and unequivocally accept these Terms.

Submission Guidelines

• Any person above 13 years of age and residing in India may enter the Contest (“Participant”) on their own behalf only. Where any person between the age of 13-18 years seeks to participate in the Contest, such person shall require the consent of his/her parent/legal guardian and on the submission of the answers in relation to the Contest, such consent shall be deemed to have been obtained by such person from his/her parent/legal guardian.
• No participation by proxy will be allowed.
• In order to participate in the Contest, you will need to login to your ‘User Account’ on the Platform (“Account”) through your existing credentials if you are already a registered user on the Platform, or register and create an Account, if you are a new or unregistered user on the Platform.
• Once you have logged in to your Account, you will be required to click on the ‘Fanzone’ section available on the ‘Home’ page of the Platform, to access the Contest. Submission of the answers to the questions specified in the Contest constitutes official entry into the Contest (“Entry”).

Opening and Closing Date

• The Contest shall open for all the GT matches in the League from 24th March 2024 at 7:30 PM IST and close on 16 May at 10:00PM IST. Participation in the Contest is permitted solely during the mid-innings break of a GT match, during which you will be allotted a 15 (fifteen) minute window to submit your Entry.
• No Entry will be accepted once the deadline lapses i.e., once the Contest closes as set out under sub-clause a above.
• ISIPL shall not accept any responsibility whatsoever for any technical failure or malfunction or any other issues which may result in any Entry not being properly registered or received.

Prize

• Winners of the Contest (“Winners”) will be selected randomly using a computerized randomizer tool from all eligible entries received.
• There will be multiple Winners in the Contest and the Participants adjudged Winners shall be contacted by ISIPL on the mobile number or email address associated with the Account of the Winner.
• Each Winner will be required to complete such steps as reasonably required by ISIPL to validate his/her victory and award the Prize (as defined below).
• A prize as determined by ISIPL at its sole discretion shall be awarded to the Winners, in accordance with the terms of the Contest (“Prize”).
• The Prize for this Contest shall be distributed subsequent to the completion of the League, in accordance with the terms outlined herein. Participants acknowledge and agree that no undertaking or guarantee is afforded by ISIPL on the timelines for the delivery of the Prize.
• Any Participant between the ages of 13 to 18 winning the Contest shall not be entitled to the Prize unless, he/she is represented by the parent/guardian, and the parent/guardian completes all necessary formalities on his/her behalf.
• ISIPL reserves the right to substitute any prize with another without providing any notice.
• The Participant adjudged the Winner may be required to submit a video testimonial (“Testimonial”), as requested by ISIPL, at no additional cost or charge to ISIPL.

Legal

• Intellectual Property/Third Party Rights: By submitting any content to the Contest on the Platform, you agree to grant ISIPL a royalty-free, world-wide, non-exclusive, perpetual and assignable right to use, copy, reproduce, modify, adapt, edit, translate, create derivative works from, transmit, and share your content and to use such content. Such content may include, without limitation, your name, username, location, the Testimonial etc. You further agree and acknowledge that ISIPL has the right to use in any manner whatsoever, all communication or feedback provided by you. The eligible Winners must, at the request of ISIPL, participate in all promotional activity (such as publicity and photography) surrounding the winning of the Prize, free of charge, and they consent to ISIPL using their name, likeness and image in all promotional materials undertaken by ISIPL.
• Indemnification:You hereby agree to indemnify, defend and hold harmless ISIPL from and against all liability and costs incurred in connection with any claims arising out of or relating to your participation in the Contest, including but not limited to any breach of obligations, representations or warranties in these Terms, or any claim arising out of any breach of a third party’s rights of any nature by you.
• Waiver:Your participation in the Contest is at your own risk and strictly in accordance with these Terms. ISIPL bears no responsibility for any loss or damage incurred as a result of your participation in the Contest, and you waive any claims against ISIPL in relation thereto.
• Breach of Terms:Any breach of the Terms will automatically void your participation in the Contest. If a breach of any of the Terms set forth herein is discovered after the award of the Prize, then ISIPL has the right to require the return of such Prize awarded to you/require the refund of the value of the Prize awarded to you (at ISIPL’s discretion), and you agree to, return such Prize/refund the value of the Prize (as required by ISIPL).
• Disclaimer: You acknowledge and agree that:
  • ISIPL shall neither be liable nor responsible for any actions or inactions of any third party and hereby expressly disclaims any and all responsibility and liability in that regard.
  • ISIPL shall neither be liable nor responsible for any damage, loss, injury or disappointment suffered by any Participant as a result of entering the Contest or accepting the Prize or any injury or damage to the Participant's or any other person's personal property including but not limited to a computer or mobile phone relating to or resulting from participation in the Contest.
  • The Prize is personal to the Winners and is not transferrable and cannot be sold under any circumstances.
  • The Prize will be awarded to the Winner on an as is basis and ISIPL will neither replace or entertain any claims regarding its quality, delivery etc. The Prize cannot be exchanged for cash or any other benefit.
  • No Prize will be awarded if the information furnished by the Participant at the time of entering the Contest, or at any subsequent stage is factually incorrect.
  • In the event a Winner does not acknowledge/accept/collect his/her prize within the timeline stated by ISIPL, such Participant shall forfeit the Prize being awarded, and Company shall have the right to award the same Prize(s) to other Participant(s).
  • You are aware that participation in the Contest does not guarantee a prize to you.
  • All collection, storage, use and disclosure of any information provided by you to ISIPL will be in accordance with ISIPL’s privacy policy available at: https://www.gujarattitansipl.com/privacy-policy
• Promotional Communication:You hereby agree to receive promotional and marketing communication including but not limited to email communication/newsletters, WhatsApp messages, mobile SMS, call etc. from ISIPL from time to time. You further expressly waive Do Not Call (DNC)/ Do Not Disturb (DND) registrations on your phone/mobile numbers for contacting you for such promotional/marketing purposes.

General

ISIPL reserves, at its discretion, the right to: (i) vary these Terms without notice, including but not limited to the opening and closing times for submission of Entry; (ii) withdraw, vary or substitute the prize associated with the Contest; (iii) disqualify any entrant who breaches these Terms or has acted fraudulently; or (iv) cancel the Contest at any stage.

Governing Law and Jurisdiction

The Contest shall be governed by and construed in accordance with Indian laws. Any disputes arising out of or in connection with the Contest and/or your participation in the Contest will be subject to the exclusive jurisdiction of the courts of Ahmedabad, India.
